Family/Partner Visa

There are a number of visas options for members of the family, such as fiancés, partners, children, parents and other family members of Australian citizens, Australian permanent residents or eligible New Zealand citizens.

Partner category fall into two categories for migration may apply to:

  • People intending to get married (fiancés), including de facto partners (including those in a same-sex relationship), and,
  • Married partners

 

Partner Temporary Visa - Subclass 820 and Permanent Visa - Subclass 801

This visa allows you to enter or stay in Australia on the basis of your married or de facto relationship with your partner:

  • on a temporary visa (usually for a waiting period of approximately two years from the date you applied for the visa)
  • on a permanent visa if, after the waiting period (if applicable), your partner relationship still exists and you are still eligible for this visa.

Your partner must provide sponsorship for you.

Partner temporary visa –subclass 820, allows you to:

  • stay in Australia with your partner, until a decision is made regarding your permanent visa
  • work in Australia
  • study in Australia, but you will not have access to government funding for tertiary study and will be charged international upfront full fees
  • enrol in Australia's medical benefits expenses and hospital care scheme, Medicare

Partner Visa: Offshore Temporary and Permanent- Subclasses 309 and 100

Your partner must provide sponsorship for you. This visa allows you to enter or stay in Australia on the basis of your married or de facto relationship with your partner:

  • on a temporary visa (usually for a waiting period of approximately two years from the date you applied for the visa)
  • On a permanent visa if, after the waiting period (if applicable), your partner relationship still exists and you are still eligible for this visa.

Prospective Marriage Visa -Subclass 300

This visa allows you to enter Australia and is initially valid for a period of nine months from the date the visa is granted. You must enter Australia and marry your intended fiancé within the visa's nine month validity period. This visa is on the basis that our relationship with your partner is ongoing. This visa do not automatically have the right to permanent residence in Australia.

You may then apply for a Partner visa when you are in Australia. At each stage of the process, your relationship with your partner will be assessed. However if you do not marry within the validity period, there may be other options available to you.

Parent Visa Options

The Parent Visa Options provides a range of visa options enabling eligible Australian citizens and Permanent Residents to sponsor visas their parents to migrate to Australia

There are several visa options for parents such as Aged Parent (residence) visa, Contributory visa (residence), Contributory aged parent (temporary) and other if you are in Australia. If you are outside Australia then the options available to you are the Parent (Migrant visa), contributory Parent (Migrant ) Visa, Contributory parent (Temporary ) visa and other.

These visa require the applicant to meet a selection criteria and there maybe others factors that may influence the choice of the visa. Selection criteria include the “balance of family” test and the sponsoring child must be settled in Australia as a permanent resident.

Child Visa Options

This visa is a permanent visa that allows a child to remain in Australia with their parent. The parent must be an Australian citizen, permanent resident or eligible New Zealand citizen.

This visa is for a child under 25 years of age

The options available in this category include: child (permanent), Orphan relative (permanent) dependent child visa, adoption (permanent ) visa, among others.
